Terms of Service
Effective August 22, 2026 · Yaad Inc. · hello@yaad.ai
1. This agreement
These Terms govern Yaad's websites, applications, interviews, family books, sharing tools, generated material, and related services (the Service). By using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
If you use Yaad on behalf of someone else—an organisation, parent, or relative—you confirm that you have authority to do so. That authority does not waive the rights of the storyteller or anyone else whose content is involved.
2. Who may use Yaad
You must be at least 18 years old and able to enter a binding agreement. Yaad is not directed to children, and you may not create an account for a child or ask a child to use the Service.
Access is by invitation during the initial launch and may be limited by capacity, supported language, device, product readiness, or legal availability. You may use the Service only where lawful and where we make it available.
3. Accounts and family roles
Give us accurate account information, protect your sign-in, and tell us promptly if someone has access who should not. You are responsible for what happens through your account, except where our failure to use reasonable security caused it.
A book may involve an owner, storyteller, contributors, viewers, and people mentioned or depicted. The owner manages day-to-day access and invitations but does not acquire the right to override the storyteller's consent or another person's rights. We may restrict content or access while reviewing a credible privacy, authority, safety, or family dispute.
Do not share credentials or use someone else's account. Use invitations and sharing controls instead.
4. Recording and consent
Do not record, upload, or process another person's voice, image, story, or family material without the permission and legal authority required where you and that person are. Recording laws vary, and some require every participant's consent.
If you arrange an interview for someone else, you must:
- explain that Yaad records the conversation and uses AI to process it;
- make sure the storyteller genuinely has a choice;
- give any notice the law requires;
- stop if they withdraw or become uncomfortable; and
- never coerce, impersonate, or record someone who cannot validly consent without an authorised guardian or representative.
Yaad records a consent entry and the accepted consent version. That supports your obligation but does not replace it or excuse recording someone who did not agree.
5. Your content and the permission you give us
User Content means recordings, transcripts, stories, photographs, documents, instructions, corrections, contributions, and anything else provided through the Service. As between you and Yaad, you keep the rights you have in User Content and confirm that you have the permissions needed to provide it.
You grant Yaad a non-exclusive, worldwide, royalty-free licence to host, copy, transmit, format, transcribe, index, retrieve, transform, display, back up, and otherwise process User Content only to:
- provide, secure, maintain, and support the Service;
- create requested interviews, drafts, books, spoken playback, sharing experiences, and outputs;
- give access to people you authorise; and
- comply with law and enforce these Terms.
This licence transfers no ownership. It ends when the relevant content is deleted, except for bounded restore windows, copies authorised recipients already hold outside Yaad, and material retained for legal, security, or dispute reasons.
The licence does not permit Yaad to sell private family content, use it in advertising, or train a general-purpose Yaad or third-party model. Research, publicity, testimonials, or model-training use require a separate, optional agreement with the person concerned.
6. AI-generated and derived material
Yaad uses AI to conduct interviews and to transcribe, retrieve, organise, summarise, classify, draft, embed, generate images from, and speak aloud material in a book.
AI output can be incomplete, inaccurate, offensive, repetitive, or inconsistent. Similar output may be generated for others. Chapters, answers, citations, memories, images, and audio are drafts—not verified historical records. Review them before publishing, gifting, or sharing. Do not rely on them for medical, legal, financial, genealogical, identity, or emergency purposes, or as proof of a disputed fact.
Spoken playback
Yaad can read text aloud in a generic synthetic voice attributed to a storyteller, including someone who has died. It is not a clone or recreation of that person's voice, and Yaad does not build per-person voice models. You must not present synthesized audio as a genuine recording or use it to deceive anyone about what a real person said.
Rights in output
To the extent the law allows, you may use Yaad-generated output associated with your book, subject to other people's rights and third-party material. We do not promise that generated material qualifies for copyright or other exclusive protection.
7. Sharing and collaboration
Owners and authorised users may invite contributors and viewers through Yaad's sharing controls. You are responsible for choosing recipients carefully and for having authority to share the material.
Recipients can save, screenshot, download, quote, or forward anything they can see. Removing access stops further access through Yaad but cannot recall a copy that already left.
Contributors keep their rights in what they provide while granting the service-processing licence in section 5 and allowing the relevant owner to consider, edit, include, or decline that contribution for the book.
8. Family, memorial, and content disputes
Family history can involve disagreement about accuracy, privacy, ownership, consent, and what a living or deceased person would have wanted. Yaad does not decide inheritance, next-of-kin status, defamation, copyright ownership, or historical truth. Controlling an account or paying for the Service does not make someone right.
We may temporarily restrict material or access while reviewing identity, authority, consent, and competing interests. We may request documentation, notify affected users where lawful, preserve limited evidence, and decline requests we cannot safely or lawfully resolve.
A request from a storyteller or someone depicted in a book does not require the account owner's approval to be considered. Our Privacy Policy explains how anyone can reach us.
9. Acceptable use
You must not use the Service to:
- break the law or infringe privacy, publicity, intellectual-property, contractual, or other rights;
- record or impersonate someone without required permission;
- present AI-generated text, images, or audio as a genuine statement or recording by a real person;
- exploit, groom, threaten, harass, defame, stalk, or endanger anyone;
- upload illegal sexual content, material exploiting minors, malware, or instructions facilitating serious wrongdoing;
- bypass access controls, probe systems without authorisation, scrape private content, or interfere with security or availability;
- submit credentials, secrets, or regulated data the Service is not designed to handle;
- reverse engineer or extract models or protected components except where law expressly permits; or
- use automated access beyond documented interfaces or reasonable personal use.
We may remove or restrict content, suspend an account, preserve evidence, or report conduct where reasonably necessary to protect people, the Service, or compliance with law.
10. Yaad's technology and feedback
Yaad and its licensors own the Service, software, design, trademarks, documentation, and technology—everything except User Content and third-party material. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service as intended.
We may use product feedback freely and without payment. Private family content does not become feedback merely because it appears in a support message.
11. Privacy
Our Privacy Policy explains what we do with information and which categories of providers process it. Where law requires consent, acknowledging a policy is not that consent; we ask separately.
12. Launch-stage service
During launch, features may change, fail, or be withdrawn. We may set reasonable limits, pause invitations, migrate data or infrastructure, and correct generated material or indexes. We will use reasonable care with private content and give appropriate notice of material changes but do not promise uninterrupted or error-free operation.
Do not use Yaad as the only copy of something irreplaceable. Keep original photographs, documents, and recordings.
13. Paid features
Yaad currently has no paid features, checkout, or subscription. When paid features launch, we will update these Terms and show the price, billing interval, renewal behaviour, cancellation method, refund rules, taxes, usage limits, and any trial conversion before purchase.
14. Third-party services
The Service depends on third-party infrastructure, authentication, AI, email, monitoring, and platform providers, each with its own terms and notices. We are responsible for selecting and managing processors as applicable law requires but cannot control an external platform's independent services or a link you choose to follow.
15. Suspension and termination
You may stop using Yaad at any time. Owners may request account or book deletion subject to identity, authority, shared-family, legal, security, restore-window, and recipient-copy limits described in the Privacy Policy.
We may suspend or terminate access for a material breach, legal or safety risk, or where continued service is no longer reasonably possible. Where appropriate, we will give notice and a reasonable opportunity to address the issue or request an available copy—unless immediate action is needed for safety, security, law, fraud, or another person's rights.
On termination, we will provide available content on verified request as described in the Privacy Policy. A printable book is not a complete copy of every item of data. Provisions that should survive by their nature—including ownership, retained licence limits, disclaimers, liability, disputes, and legal preservation—will survive.
16. Rights complaints and takedowns
Send copyright, privacy, consent, impersonation, or other rights concerns to hello@yaad.ai. Tell us enough to locate the material, explain your connection and the right involved, and provide a way to reach you. Do not send unrelated private family content. We may verify identity and notify the affected account owner where appropriate and lawful.
17. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL GENERATED MATERIAL ARE PROVIDED “AS IS” AND “AS AVAILABLE.” YAAD DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, THAT GENERATED MATERIAL WILL BE ACCURATE, OR THAT A BOOK WILL SETTLE A FAMILY OR HISTORICAL DISPUTE.
Nothing here excludes warranties or consumer rights that cannot lawfully be excluded.
18. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YAAD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL ARISING OUT OF OR RELATING TO THE SERVICE.
Yaad's total aggregate liability for claims relating to the Service is limited to the greater of (a) US $100 or (b) the amount you paid Yaad in the twelve months before the event giving rise to the claim.
These limits do not apply where liability cannot lawfully be limited or excluded, including death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or Yaad's gross negligence or wilful misconduct. Nothing limits mandatory consumer rights.
19. Indemnity
You will defend and indemnify Yaad against third-party claims arising from content you submitted that was unlawful or infringed rights; your lack of required permission, consent, or authority; or your intentional misuse of the Service in material breach of these Terms.
This indemnity does not apply to claims caused by Yaad's own acts or omissions, including security, privacy, or operational failures, and does not cover ordinary disagreements between family members about a book.
20. Disputes and applicable law
No arbitration and no class-action waiver. Contact hello@yaad.ai first and we will try to resolve the issue informally within 30 days. If informal resolution fails, either party may bring a claim in a court with lawful jurisdiction.
Applicable law governs these Terms without limiting any mandatory consumer protection, eligible small-claims process, or non-waivable local forum right available where you live.
21. Changes to these Terms
We may update these Terms for new features, providers, pricing, law, or risk. We will post a new effective date and give reasonable additional notice of material changes.
A change will never retroactively authorise use of private family content for training or advertising. If you do not accept a material change, you may stop using the Service and request available export and deletion before it takes effect.
22. General
If a provision is unenforceable, the rest remains effective. A failure to enforce a provision is not a waiver. We are not responsible for delay caused by events beyond reasonable control. These Terms and policies expressly incorporated into them are the entire agreement about the Service and replace prior discussions about the same subject.
You may not assign your rights or obligations without our consent. Yaad may assign these Terms in a merger, reorganisation, financing, or sale only subject to the Privacy Policy's no-sale, no-advertising, and no-training commitments for private family content. Notices may be provided through the Service or the email associated with an account. Headings aid reading and do not change meaning. Except where law says otherwise, these Terms create no rights for third parties.
